Terms of Service

These Terms of Service (“Terms”) govern your use of Digest (“Digest,” “we,” “us”), the reading app available at app.thedigestco.org and on iOS. By creating an account, signing in, or otherwise using Digest you agree to these Terms. If you do not agree, do not use Digest.

1. What Digest is

Digest is a personal reading tool. It lets you subscribe to RSS feeds, optionally connect an email account to find newsletters you already receive, import those as feeds, read and highlight articles, and organize them into channels and tags. Digest does not publish, produce, or endorse the content it fetches from third-party feeds or newsletters.

2. Your account

You need an account to use Digest. You can create one with email, phone, Sign in with Apple, or Sign in with Google. You are responsible for keeping your sign-in credentials secure and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately.

You must be at least 13 years old to use Digest. If you are under the age of majority in your jurisdiction, you may use Digest only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

3. Connecting email accounts

Digest’s newsletter-import feature requires you to authorize limited read access to your Gmail, Outlook, or iCloud inbox. When you connect an account:

• We only read message headers to detect newsletter senders. We do not read message bodies or attachments.
• You can disconnect at any time from Digest’s settings, or by revoking access from your email provider directly.
• Our handling of this data is described in our Privacy Policy.

4. Third-party content

Articles, newsletters, feeds, images, and other content that Digest fetches on your behalf are the property of their respective publishers and are governed by those publishers’ own terms. Digest makes no representation as to the accuracy, legality, or appropriateness of third-party content. Your use of that content must comply with the source’s terms.

5. Acceptable use

When using Digest, you agree not to:

• use Digest for any unlawful purpose or in violation of any applicable law or regulation;
• attempt to interfere with, disrupt, or gain unauthorized access to Digest, our servers, or any accounts other than your own;
• use Digest to access email or content you are not authorized to access;
• reverse engineer, decompile, or extract the source code of Digest except to the extent permitted by law;
• use automated means to access Digest in a way that degrades service for others, circumvents rate limits, or scrapes content at scale;
• resell, sublicense, or commercially redistribute Digest or its output without our written permission.

6. Your content

Highlights, notes, tags, channels, and other data you create in Digest remain yours. You grant Digest a limited, non-exclusive, worldwide license to store, process, display, and transmit this data solely to operate the service for you and across your devices. This license ends when you delete the data or your account.

7. Intellectual property

Digest’s name, logo, design, code, and other original materials are owned by us or our licensors and are protected by intellectual-property laws. These Terms do not transfer any ownership of Digest to you. We grant you a personal, non-transferable, revocable license to use Digest in accordance with these Terms.

8. Fees and subscriptions

Digest may offer free and paid tiers. Pricing, billing, and renewal terms for any paid plan will be presented to you at the time of purchase and are incorporated into these Terms by reference. Except where required by law, fees are non-refundable.

9. Termination

You can stop using Digest and delete your account at any time from settings. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the service. Upon termination, the license in Section 6 ends and we will delete your data as described in our Privacy Policy, except as necessary to comply with legal obligations.

10. Disclaimers

Digest is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that Digest will be uninterrupted, error-free, secure, or free of harmful components, or that any content will be accurate or available.

11. Limitation of liability

To the fullest extent permitted by law, Digest and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of Digest. Our total aggregate liability for all claims relating to Digest will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to liability or (b) one hundred US dollars (USD 100). Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Digest and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of Digest, your content, or your violation of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or to Digest will be resolved in the state or federal courts located in [Your County], [Your State], and you consent to the personal jurisdiction of those courts. If you are a consumer in the EEA or UK, this section does not override mandatory consumer protections available to you.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in-app or by email before they take effect. The “Last updated” date at the top of this page reflects the most recent revision. Your continued use of Digest after a change takes effect constitutes acceptance of the updated Terms.

15. Miscellaneous

These Terms are the entire agreement between you and Digest concerning the service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
